What are the most important considerations in divorce? P.1

Choosing to end a marriage is never an easy decision, and couples who decide to make that decision typically have gone through a lot of suffering and have thought through their family situation a lot by the time they get to that point.  In making the decision to divorce, there is a lot to consider.

According to the Institute for Family Studies, there are four main areas that people tend to take into consideration before filing for divorce. The institute bases these four areas on interviews with people in the process of contemplating divorce. Put briefly, these areas are: children, happiness, money and love. 

Each of these four areas is very important to consider prior to filing for divorce, and two of them together constitute a lot of what has to get worked out in the legal process that is divorce. We are speaking, of course, of both child custody issues and property division. Both areas can serve as points of polarization, sources of dispute, for couples. There is good reason for this. Not only does divorce have a huge emotional effect on children, it can also have a profound financial effect on a family as well.

One of the findings of the institute is that financial considerations tend to be framed in very rational terms. This is important, because divorcing couples need to prepare for the financial changes that result from divorce, and this should involve careful consideration of the practical costs involved. Couples do well, of course, to work together to come up with a mutually acceptable agreement regarding property, but a spouse should also advocate for his or her interests in the negotiation process.
