Texas divorce process can be complicated

The divorce process is a major turning point in a person's life in Texas. It usually comes with difficult decisions, challenging transitions and conflicting emotions. Divorce may also involve major lifestyle and economic changes, in addition to being a person's first time experiencing a legal proceeding.

The divorce process is complex, with unfamiliar terms potentially adding stress to one's overall experience. However, an attorney can educate one about divorce law and all of one's legal options. This is important when addressing matters such as property division, asset distribution, alimony, child support and child custody.

In the state of Texas, a majority of divorces are filed as no-fault divorces. This does not mean that neither party is to blame in the divorce; it simply means a person does not have to prove that he or she is entitled to get a divorce. It means that the personality conflicts and discord are so great that one no longer benefits from staying married to the other party and that reconciliation is not reasonably possible. If a divorce is pursued based on fault, evidence of mental hospital confinement, abandonment, felony conviction, cruelty or adultery must be provided to the court. Determining grounds can have an effect on all aspects of the divorce.

To get results during the divorce process in Texas, it may be necessary to go to trial. However, a majority of cases can be resolved outside of the courtroom through informal or formal settlement processes. In either situation, a person has the right to fight for his or her best interests.
