Unfortunately, although a milestone Supreme Court decision upheld the right of same-sex couples to marry throughout our nation, our state Legislature has not redrafted the Texas Family Code to account for same-sex marriages, divorces or child custody situations.

This poses unique challenges for same-sex spouses seeking a divorce or same-sex couples with child custody issues. For example, there may be children from a previous marriage. There may be adopted children, children conceived through means of assisted reproduction, or a couple may have used a gestational carrier. The marriage may have begun as a domestic partnership.
