During a divorce, one party may request spousal support or alimony, which Texas statutes refer to as spousal maintenance. Spousal maintenance can be temporary or for an extended period, depending on a variety of factors.

Typically, courts award spousal maintenance in accordance with Chapter 8 of the Texas Family Code and consider the following circumstances:

  • Domestic violence convictions
  • Whether a spouse is incapable of providing for minimum reasonable needs because of a physical or mental disability
  • The length of the marriage
  • Whether a spouse can earn sufficient income to meet minimum reasonable needs and his or her due diligence in attempting to do so
  • Special needs of a child

HOW IS THE AMOUNT AND DURATION OF SPOUSAL SUPPORT DETERMINED?

In most cases, when Texas courts award spousal maintenance, it is for a limited time until the spouse receiving payments has the opportunity to find employment or acquire an education or skills necessary for employment. The length of the marriage will play a major role in the duration of payments, which rarely exceeds 10 years.
